.TX1 *** OPERATION OF THE RANCH BY TENANT, PROVISIONS ***********
{!P}. LIVESTOCK PRODUCTION. The LESSEE shall stock the farm
with livestock of his choosing, except he shall not stock permanent
native pastures with more than {MAXIMUM_STOCK} animal units.
An animal unit consists of one of the following: (a) one cow
and nursing calf, (b) one horse, or (c) one thousand pounds of
weaned calves.
{!P}. GENERAL MAINTENANCE. LESSEE will maintain the ranch during
his tenancy in as good condition as at the beginning, normal
wear, depreciation and damages from causes beyond LESSEE'S control
excepted. He shall occupy and use the ranch in a manner to protect
LESSOR'S claim of title as against all adjoining owners.
{!P}. GOOD HUSBANDRY. LESSEE also agrees to operate the ranch in
an efficient manner, using good husbandry to conserve LESSOR'S
property. LESSEE will use due diligence to prevent noxious weeds
from spreading and will keep the weeds and grasses under control
so as not to contaminate the ranch with undesirable vegetation so
far as possible. In the treatment of noxious plants with
chemicals, with LESSOR'S prior oral agreement, the LESSOR and
LESSEE shall share equally in the cost of materials. The cost of
application shall be borne by LESSEE. In the event weed control
measures are undertaken by LESSEE for the purpose of harvesting a
grass seed crop, LESSEE shall bear the cost of all materials used
for such purpose unless an agreement is reached with LESSOR for
participation in such grass seed crop.
{!P}. CROPPING PRACTICES. Without the specific approval of
LESSOR, LESSEE will not (a) plow permanent pastures, (b) cut live
trees for sale or personal use but will use only dead timber as
designated by LESSOR, (c) allow livestock other than his own on
ranch land, (d) burn or remove straw or grass grown on the ranch,
(e) pasture new seedings of legumes and grasses in the year they
are seeded, nor (f) plant legumes on land not known to be thoroughly
inoculated without first inoculating the seed.
{!P}. LIVESTOCK PRACTICES. LESSEE will follow health and
sanitation measures and guard against disease in his livestock.
{!P}. WASTE. LESSEE will not commit waste on or damage to the
ranch and will use due care to prevent others from doing so.
{!P}. FIRE PROTECTION. LESSEE will not house automobiles,
motor trucks or any motorized machinery or property on the leased
premises.
{!P}. MAINTENANCE OF IMPROVEMENTS. LESSEE will maintain
buildings, fences and other improvements in as good repair and
condition as they are when he takes possession, and in as good
repair and condition as they may be during the term of this lease
except for ordinary wear and tear, loss by fire, or unavoidable
depreciation or destruction.
{!P}. MATERIALS AND LABOR. LESSOR will furnish materials
for capital improvements on the ranch not exceeding, in any event,
the cost of $500 during any one year without the prior written
agreement of LESSOR. LESSEE will perform all labor for normal
maintenance and repair.
{!P}. ADDITIONAL IMPROVEMENTS. LESSEE will not without written
approval of LESSOR (a) erect or permit to be erected on the
ranch any non-removable structure or building, or (b) incur any
expense to the LESSOR for such purpose.
{!P}. CONSERVATION PRACTICES. LESSEE will control soil erosion
as completely as practicable by filling in or otherwise controlling
small washes or ditches that may form.
{!P}. CONSERVATION STRUCTURES. LESSEE will keep in good repair
all open ditches, preserve all established water courses and
refrain from any operation or practice that cause injury or
damage to the leased premises.
{!P}. GOVERNMENT PROGRAMS. The Ranch will be operated in
compliance with Government programs including the planting of any
crops required to maintain existing crop allotments. LESSEE agrees
to maintain adequate cover on any acreage used as layout acreage for
crops on other farms to prevent erosion thereof and to tend such
acreage to prevent the growth of weeds or trees on such land.
.TX2 *** CONSERVATION RESERVE PROGRAM ACREAGE INCLUDED **********
{!P}. CONSERVATION RESERVE PROGRAM ACREAGE. {CRP_ACRES} Acres
of crop land included on the leased premises is leased to LESSEE
subject to all the terms and conditions of the Conservation
Reserve Program Contract No. {CRP/CONTRACT_NO.} between LESSOR
and the Commodity Credit Corporation dated {CRP/CONTRACT_DATE}, a
copy of which is attached to and made a part of this agreement.
LESSEE is hereby assigned the right to receive all of the rent
and all cost-share payments under said agreement and, unless
LESSEE elects not to become a successor-in-interest under said
contract, he agrees to undertake and perform all requirements of
LESSOR thereunder and to comply with all the terms and conditions
of said contract. If LESSEE elects not to become a successor-in-
interest under the provisions of paragraph 21 of said contract or
fails to comply with such agreement, LESSEE agrees to pay all
damages, costs and penalties, including any liquidated damages
due the Commodity Credit Corporation for such breach.
.TX3 *** CONSERVATION RESERVE PROGRAM ACREAGE EXCLUDED **********
{!P}. CONSERVATION RESERVE PROGRAM ACREAGE. {CRP_ACRES} Acres
of crop land included on the ranch property described above is subject
to the terms and conditions of a Conservation Reserve Program
Contract No. {CRP/CONTRACT_NO.} between LESSOR and the Commodity
Credit Corporation dated {CRP/CONTRACT_DATE} and such acreage is
specifically excluded from this lease by mutual agreement of the
parties. LESSEE agrees to cooperate with LESSOR to prevent any
violation of the terms of that agreement of which LESSOR agrees
and undertakes to perform during the term of this lease.
